Yu Huaying child abduction case retrial 2nd-round Moderation starts today

On June 24, 2019, Yu Huaying's case of child abduction and trafficking was pronounced in the first instance of the Huanggang Intermediate People's Court in Hubei Province. However, shortly after the verdict, Yu Huaying appealed, arguing that her actions did not constitute a crime and asked for a retrial of the case.

On July 31, 2020, the Higher People's Court of Hubei Province reviewed Yu Huaying's appeal and issued a 2nd-round Moderation ruling on August 23 of the same year, rejecting Yu Huaying's appeal and upholding the original judgment.

On October 26, 2020, the Higher People's Court of Hubei Province retried the case again. During the retrial process, the court comprehensively investigated the facts of the case and invited experts and scholars in relevant fields to participate in the discussion, providing a more fair and objective trial basis for the case.

After a long period of investigation and repeated arguments, the Higher People's Court of Hubei Province finally determined that Yu Huaying's actions did constitute the crime of child abduction. According to the relevant provisions of the Criminal Law of the People's Republic of China, Yu Huaying was sentenced to 20 years in prison and fined 50,000 yuan.

This result fully reflects the fairness and authority of the law, and also reminds people to be vigilant to prevent such crimes from happening. At the same time, this case also warns us that criminal acts must be severely punished in accordance with the law to maintain social order and public interests.
